Step-by-Step Guide to Buying Property in Turkey

Turkish Premier Homes is here to guide you through the entire property buying process in Turkey, ensuring that you understand every step along the way. Here's a breakdown of the buying process:

Step 1: Finding Your Home

Once you have found your ideal home, we give you time to think and discuss your decision. We will then arrange a meeting to go through any queries you may have. Once you are happy and comfortable to proceed, we will arrange an appointment with a solicitor.

Step 2: Signing the Contract

All purchasers and the seller, along with a state-qualified translator, must be present at the solicitor's office. The solicitor will draft a legal contract between the parties, detailing any extras or negotiated terms, the payment schedule, and the deposit required. This contract is legally binding, and breaking its terms typically results in penalties.

The cost of the solicitor, contract, and translator is £350.

If you wish to prepare a power of attorney, the cost is £160 (£130 if arranged at the same time as the purchase contract).

Step 3: Military Check & Title Deeds Application

Once the deposit has been paid and the paperwork is complete, the documents, along with passport copies and 4 passport-sized photographs, will be submitted to government offices for a military clearance check. This process can take up to 4-6 months, and during this time, the seller may allow you to use the property before the deeds are transferred to your name.

Step 4: Military Clearance Check

The military check ensures that the property is not located on government land. The cost of the military clearance check is 800 Lira.

Step 5: Deed Collection & Final Payment

Once your title deeds are signed and returned from the government, they are sent to the local deed office. Only the named buyers can sign for and collect the deeds. If you're not in Turkey when the deeds are ready, you can arrange a power of attorney for someone else to collect them on your behalf.

The government tax is a standard fee of £120, and the property tax is 3.3% of the property's cost.

Step 6: Utilities & Insurance

After obtaining the deeds, you'll need to set up or transfer utilities (water and electricity) in your name. We will assist you with this process. The cost for connection and name transfer is £500.

It's highly recommended to have property and contents insurance, as well as earthquake insurance, which is mandatory in Turkey. The cost of insurance depends on the value and size of the property. For quotes or further information, feel free to contact us.

Don't forget about the annual council tax, which is based on the value and size of the property and is due one year after receiving the title deeds.

Power of Attorney

A power of attorney is a legal document that allows you to nominate someone to act on your behalf during the property purchase process. This is typically used when the buyer is not present in Turkey when the title deeds are ready.

Power of attorney in Turkey costs £160 (£130 if arranged when the purchase contract is signed). If you choose to arrange the power of attorney in the UK, it must be notarized and apostilled, with an additional cost of £110 for translation and legalization in Turkey.

It's important that the names of all purchasers are included in the power of attorney document. This ensures that the person acting on your behalf is authorized to represent all parties involved in the purchase.
